Policies

A 50% deposit/retainer fee is required to secure your appointment date and time and must be paid 1 month prior to appointment/event date. The remaining balance is due 1 week prior to the event date. All payments are to be paid vie e-transfer to simonemichaelsmua@gmail.com. The person responsible for the entire balance of payment is the person who has signed the Contract. 

In the unforeseen or foreseen circumstance that this Contract's agreed date must change and Michelle Simoneau-Clayton of Simone Michaels Makeup Artistry agrees to the new date, a new Contract is required to secure the new date. Michelle Simoneau-Clayton of Simone Michaels Makeup Artistry will void the Original Contract. All previous payments and the retainer fee for the original event date will remain non-transferrable and non-refundable.

Your booking is a reserved spot. If your event is cancelled, no portion of the retainer fee will be reimbursed. Under the foreseen or unforeseen event that the Client must cancel, Michelle Simoneau-Clayton of Simone Michaels Makeup Artistry must be notified of event cancellation 14 days prior to the service date, or the Client will be responsible for 100% of the remaining balance agreed up in this Contract. Any changes to the terms of this Contract will be at the discretion of Michelle Simoneau-Clayton of Simone Michaels Makeup Artistry. In the unforeseen event that Michelle Simoneau-Clayton becomes ill or is unable to perform services on the reserved event date, she will refund the entire retainer fee to the signed holder of this Contract.

It is understood and agreed that Michelle Simoneau-Clayton of Simone Michaels Makeup Artistry or her assistant(s) will not be liable to the Client or any Agent Associate of the Client, for any mistake or error in judgement or for any act of omission done in good faith and believed to be within the scope of authority conferred or implied by this Agreement. The Client agrees not to hold Michelle Simoneau-Clayton of Simone Michaels Makeup Artistry or her assistant(s) liable for property damages or event day complications that could result in monetary loss.

Any skin conditions shall be reported by the Client to the Makeup Artist prior to application and if need be, a sample test of makeup may be performed on the skin to test reaction. The Client agrees to complete the Simone Michaels Client Intake Form. The Client agrees to release Michelle Simoneau-Clayton or her Assistant(s) from liability for any skin complications due to allergic reactions. Michelle Simoneau-Clayton or her Assistant(s) reserve the right to refuse services or alter services if unsanitary conditions exist and/or contagious infections are present. The Client understands and acknowledges that Michelle Simoneau-Clayton or her Assistant(s) may alter service(s) or not perform services where any contagious infections or illness are present. There shall be no refund of any paid retainer fee and the Client will pay the remaining balance in full. It is understood that Michelle Simoneau-Clayton and her Assistant(s) are only liable for the service completed and provided and cannot be held liable for the services of Other Contracted Vendors. It is understood that in no event shall Michelle Simoneau-Clayton or her Assistant(s) be liable for consequential damages of any kind.

The responsibility of Michelle Simoneau-Clayton and her Assistant(s) shall not be liable for any loss, injury, illness or damage to any Client and/or property. The Client agrees that Michelle Simoneau-Clayton of Simone Michaels Makeup Artistry or her Assistant(s) will not be held liable for any damages to any Client and property in connection to labour unrest, mechanical construction failures, illness, local laws, weather, strikes, thefts, pilferage, or defaults. Michelle Simoneau-Clayton and her Assistant(s) are not responsible for Acts of God, Natural Disasters, and Act of Government (such as Declaration of National or Local Emergency), terrorist activities, or Other Incidents not within the control of the Vendor, ie., accident, death in the family, pregnancy, illness or sudden tragic circumstance.

Michelle Simoneau-Clayton of Simone Michaels Makeup Artistry and her Assistant(s) will use their artistic and reasonable efforts to ensure that the Client's desired services are performed to excellence. The Client understands that Michelle Simoneau-Clayton has the final say regarding aesthetic judgement and the artistic quality of services rendered. Dissatisfaction with Michelle Simoneau-Clayton or her Assistant(s) aesthetic judgement or artistic ability are not valid reasons for termination or this Agreement or request for return of any fees paid.

The Client expressly agrees to take best efforts to provide the Simone Michaels Makeup Artists (Vendor) and Assistant(s) or Other Staff with a safe and appropriately sanitized working environment and conditions. If the circumstances are deemed unsafe, have an implied threat of injury or harm to the Vendor (Simone Michaels Makeup Artistry) MUA's and their Assistant(s) or Other Staff or equipment, they reserve the right to remove persons or equipment from the premises and the Client shall be responsible for full payment of services.

The Client and all parties obtaining services from Michelle Simoneau-Clayton and her Assistant(s) of Simone Michaels Makeup Artistry agree that they will not, directly or indirectly, make or ratify any defamatory comments, reviews or remarks as defined by law, in writing, orally or electronically about Michelle Simoneau-Clayton or her Assistant(s) and their respective products and services. By receiving services, the Client agrees to this Contract Stipulation whether or not this Contract is signed by the party obtaining the service. The Client acknowledges and agrees that verbal, physical, emotional abuse is unacceptable by any person at the event and shall be grounds for Michelle Simoneau-Clayton or her Assistant(s) to cease services immediately. The Client acknowledges that they will not be entitled to a refund or for any work already performed. The Client may not review Michelle Simoneau-Clayton or her Assistant(s) poorly on Social Media or any other review sites if such an instance occurs.

The Client authorizes Michelle Simoneau-Clayton to use photos or videos of the Client for her future Clients to view. Posting is on Michelle Simoneau-Clayton's website, simonemichaelsmakeupartistry.com, Facebook page Simone Michaels Makeup Artistry, advertisements, and on Instagram @simonemichaelsmua. Michelle Simoneau-Clayton and her Assistant(s) will always ask permission for photography before posting their professional photos. Michelle Simoneau-Clayton reserves the right to post proper credit of her and her Assistant(s) work.
